< 형사법원의 종류>

영국(잉글랜드와 웨일즈)에서 형사사건을 관할하는 법원조직은 다음과 같이 다섯 종류의 법원으로 구성되어 있으며 아래로 갈수록 상급법원입니다.

1) 치안판사법원(Magistrates’ courts)
2) 형사법원(The Crown Court),
3) 고등법원(The High Court of Justice),
4) 항소법원(The Court of Appeal),
5) 대법원(The Supreme Court; 예전의 상원)

ㅇ 치안판사법원 (Magistrates’ Courts)
 영국 내에는 많은 수의 치안판사법원이 있는데, Local Justice Area (자세한 리스트는 Local Justice order 2005(SI 2005 No.554)에 수록되어 있음)라 일컫는 기준에 따라 관할구역이 나누어집니다. 치안판사법원은 치안판사법원법(Magistrates’ Court Act 1980)에 따라 경미한 형사범죄 및 선택가능죄 (either-way offence; 치안판사법원과 형사법원 양쪽 어디에서나 다뤄질 수 있는 죄)  에 대한 관할권을 가집니다.
 영국의 모든 형사사건은 먼저 치안판사법원으로 기소가 이루어지는데, 경미한 형사범죄 및 선택가능죄의 경우, 동법원에서 재판이 수행되기도 하고 선택가능죄 및 가공소죄(可公訴罪)의 경우, 형사법원으로 송치되기도 합니다. 또한 치안판사법원은 최고 6개월 이하의 징역 그리고/또는 £5,000 이하의 벌금형까지 선고할 수 있습니다.
 치안판사법원에서의 재판을 주재하는 재판관은 두 종류로 나뉘는데, 법조인 자격을 가진 구역법관 (District Judge)과 치안판사(Magistrate; justice of peace; 무보수의 명예직 재판관으로서 비법률가인 일반인 중에서 지역사회의 존경을 받는 자를 임명)로 나뉩니다.  구역법관은 단독으로 재판을 진행할 수 있는 반면 치안판사의 경우, 2인 이상의 치안판사로 구성된 합의재판부(보통 세 명이 배석하는 것을 원칙으로 함)를 구성하여야 합니다. 치안판사가 단독으로 배석하는 경우, 행사할 수 있는 권한이 보석 내용변경이나 기간연장 등 정도로 축소됩니다.

ㅇ 형사법원 (The Crown Court)
 형사법원의 사법권은 시니어 법원법(Seniors Courts Act 1981)에 근거합니다. 형사법원은 각 지역마다 설치되어 있지만 한 개의 법원으로 간주합니다. 형사법원에서 사건을 다룰 경우, 보통 사건이 일어난 곳에서 가까운 관할구역에 위치한 법원으로 송치되며, 동법원에 공소되는 모든 재판은(선택가능죄, 가공소죄) 재판관과 배심원단의 배석하에 수행됩니다.
 치안판사법정에서 내려진 유죄판결과 선고된 형에 대한 항소 역시 형사법원에서 담당하며, 항소심의 형태로 진행됩니다. 항소심은 형사법원 재판관과 두 명의 치안판사가 배석한 가운데 진행됩니다.
선택가능죄 관련사건에서 치안판사 혹은 구역법관이 치안판사법원의 사법권내에서 선고하기에는 형량이 너무 가볍다고 판단할 경우, 해당 사건의 형 선고를 형사법원으로 송치할 수 있습니다. 이를 선고를 위한 송치라고 하는데, 재판은 형사법원 법관이 맡게 됩니다.
 형사법원은 때로 경미한 형사사건을 담당할 수 있는 사법권도 가집니다. 예를 들어 해당 경미한 형사사건이 가공소죄 또는 선택가능죄와 연계된 사건인 경우 형사법원에서 담당하게 됩니다.
형사법원 법관은 보통 임명된 순회법관(circuit judge)이 맡게 되며 고등법원 법관과 비상근법관(recorder; 파트타임 법관) 역시 형사법원의 재판을 주재할 수 있습니다.

ㅇ 항소법원(Court of Appeal)
 항소법원은 영국 법원조직 중 제2의 상급법원으로서 형사법원 판결이나 형 선고에 대한 항소심을 다룹니다. 항소법원에는 형사부외에 민사소송 관련 항소심을 담당하는 민사부가 따로 있습니다. 항소법원의 주법관은 “Lord Justice of Appeal”이라 부르며, 때때로 고등법원 법관이나 형사법원 법관이 항소법원에서 재판을 주재할 수 있습니다.

ㅇ 대법원(The Supreme Court)
대법원은 영국 법원조직의 최고 상급법원입니다. 헌정개혁법(Constitutional Reform Act 2005)에 따라 설립되었으며, 2009년 10월 1일에 최상급 법원으로서의 상원(the House of Lords)을 대체하게 되었습니다. 대법원은 대법원 규칙(Supreme Court Rules (SI 2009 No.1603)에 따른 관례와 절차로 운영됩니다.
 대법원에서는 항소법원(의 형사부)에서 올라온 상고에 대한 재판 기능을 수행하지만, 이는 일반 대중에 중요한 영향을 미칠 법 해석과 관련된 항소에 한해서만 허락됩니다.

ㅇ 고등법원 (The High Court of Justice)
 고등법원은 치안판사법원에서 올라온 항소심에 대한 재판기능을 수행하는데, 1심 형사판결 중 법률문제나 절차문제에 관한 항소심 재판만을 진행합니다. 치안판사법원에서 올라온 항소는 “appeals by way of case stated”라 일컬어집니다.
 고등법원은 또한 치안판사법원이나 형사법원의 결정에 대한 적법성을 심사하는 “judicial review”를 통해 항소심 기능을 수행하기도 하며 “Judicial review”는 오직 고등법원의 허가 하에 법률문제나 절차문제에 관한 부분만 다룰 수 있습니다.
 고등법원의 법관은 죄가 무거운 가공소죄 사건의 경우, 배심원단이 배석하는 형사법원의 재판을 주재하기도 합니다.

ㅇ 청소년 ( Juveniles)
 청소년(만 18세 미만인 자)의 형사사건 재판은 치안판사법원의 하나인 청소년법원(Youth Court)에서 주관합니다. 그러나 청소년 재판은 예외적으로 형사법원이나 일반 치안판사법원에서 진행될 수도 있습니다.(예를 들어, 청소년의 형사사건이 성인의 사건과 연계된 경우)

 ㅇ 형사사건은 아래의 세 가지로 분류된다:

(i) 경미한 형사범죄Summary offences
비교적 심각하지 않은 범죄로 선고 가능한 최고 형량이 6개월 이하의 징역 또는 무제한의 벌금형인 죄를 말한다. “Summary Offenc”의 예로는 운전 중 법규위반, 경미한 수준의 파손 등을 들 수 있다. 이들 경미한 형사범죄는 모두 치안판사법원에서 담당한다.

(ii) 선택가능죄 (Either-way offences)
심각성이나 구형 형량 면에서 범위가 넓은 죄를 칭한다. 선택가능죄의 예로는 위험한 개를 풀어놓아 공공의 안전을 위협하는 행위(최고 2년형), 절도(최고 7년형), 성폭행(최고 10년형)등의 범죄가 이에 속한다. 선택가능죄는 치안판사법원에서 담당할 수도 있고, 형사법원에서 담당할 수도 있다.

(iii) 가공소죄(可公訴罪) Indictable only
가장 심각한 종류의 범죄. 가공소죄의 예로는 심각한 신체적 피해를 의도한 상해(최고 종신형), 살인(최고 종신형)과 강간(최고 종신형)을 들 수 있다. 이러한 가공소죄는 오직 형사법원에서만 다뤄질 수 있다.


ㅇ TYPES OF CRIMINAL COURTS

There are five types of courts that deal with criminal cases in England and Wales. They are (in order of superiority):

 1) Magistrates’ courts,
 2) The Crown Court,
 3) The High Court of Justice,
 4) The Court of Appeal,
 5) The Supreme Court (formerly the House of Lords).

ㅇ Magistrates’ Courts

There are many magistrates’ courts situated around the country and they are organized on the basis of ‘local justice areas’ (these are listed in the Local Justice order 2005 (SI 2005 No.554).

Under the Magistrates’ Court Act 1980 (“MCA 1980”), a magistrates’ court has jurisdiction to try any summary offence and any offence which is triable either-way, irrespective of where the offence was committed.
All criminal cases start off in a magistrates’ court. They then either remain in the magistrates’ court (summary and either-way offences) or they are sent to the Crown Court for trial (either-way offences and indictable only offences).

At present, the maximum sentence that a magistrates’ court can impose for any one offence is 6 months’ imprisonment and/or a £5000 fine.

There are two types of ‘judges’ in magistrates’ courts. The first are called district judges (formerly known as stipendiary magistrates). District judges are paid and are legally qualified. They sit alone. The other type are magistrates (also known as justices of the peace). Magistrates do not have to be legally qualified and are not paid a salary. There must usually be a minimum of two magistrates (there are usually three) sitting in a magistrates’ court but single magistrates have some limited powers which include extending or varying bail.

ㅇ The Crown Court

The Crown Court derives its jurisdiction from the provisions of the Senior Courts Act 1981. It is regarded as a single court but it sits in many different locations and a case will normally be tried at a location near where the offence allegedly occurred.

All trials on indictment (either way or indictable only offences) are tried at the Crown Court before a judge and a jury.

Appeals against conviction and sentence from the magistrates’ courts are heard in the Crown Court. The appeal takes the form of a re-hearing. Appeals are heard by a Crown Court judge sitting with two magistrates.

In cases of either-way offences where magistrates or district judges feel that their sentencing powers are insufficient, they may send them to the Crown Court for sentencing. These are called committals for sentence and are dealt with by a Crown Court judge.

The Crown Court also has jurisdiction to deal with certain summary offences (for example where it has been sent to the Crown Court because it is linked to an indictable only or either-way offence).

Crown Court judges are usually circuit judges who have been appointed after application. High Court judges and recorders (part-time judges) may also sit in the Crown Court.

ㅇ Court of Appeal

The Court of Appeal is the second most senior court in the English legal system. Appeals from the Crown Court against conviction or sentence are to the Court of Appeal (Criminal Division). There is a separate Civil Division of the Court of Appeal that deals with appeals in civil cases.

The Court of Appeal’s main judges are called Lord Justices of Appeal. High Court judges and sometimes Crown Court judges also sit in the Court of Appeal.

ㅇ The Supreme Court

The Supreme Court is the highest court of the UK. It was established under the Constitutional Reform Act 2005 and on 1 October 2009, it replaced the House of Lords. Its practice and procedure is governed by the Supreme Court Rules (SI 2009 No.1603).

Appeals from the Court of Appeal (Criminal Division) are heard by the Supreme Court but permission to appeal will only be granted where the appeal involves a point of law of general public importance.

ㅇ The High Court of Justice

The High Court can hear appeals from the magistrates’ courts but only on points of law. Appeals from the magistrates’ courts are called appeals by way of case stated.

The High Court can also judicially review decisions of the magistrates’ courts or the Crown Court. Judicial reviews can only be heard with permission from the High Court on matters of law.

High Court judges can sit with a jury in the Crown Court in the most serious of offences.

ㅇ Juveniles

The criminal trial of a juvenile (a person who has not attained the age of 18) usually takes place in a special form of the magistrates’ court known as the youth court. In certain circumstances, however, the trial of a juvenile it can take place either in the Crown Court or an ordinary magistrates’ court (for example where a juvenile’s case is linked with an adult’s case).

ㅇ Criminal offences are divided up into three types:

(i) Summary offences
These offences are the least serious and attract a max. sentence of 6 months’ imprisonment and/or an unlimited fine. Examples of summary offences include driving offences, low-level criminal damage and common assault. Summary offences are tried in the magistrates’ courts.

(ii) Either-way offences
These offences are wide-ranging in terms of their seriousness and the sentences they attract. Examples of either-way offences include having a dog dangerously out of control in a public offence (max. 2 years’ imprisonment), theft (max. 7 years’ imprisonment), and sexual assault (max. 10 years’ imprisonment). Either-way offences can be tried either in the magistrates’ courts or in the Crown Court.

(iii) Indictable only
These are the most serious types of offences.  Examples of indictable only offences include wounding with intent to cause grievous bodily harm (max. life imprisonment), murder (max. life imprisonment) and rape (max. life imprisonment). Indictable offences can only be tried in the Crown Court.
