(a) 법원 보석:
일반적으로 형사재판에 회부된 모든 이는 보석을 통해 석방될 수 있는 권리를 가진다. 단, Bail Act 1976(보석법)의 schedule 1에 명시된 예외경우는 제외한다. 가장 일반적인 보류사유는 피고가 보석으로 석방될 경우 아래의 위험을 초래할 가능성이 있다고 판단될 때이다:
-지정된 날짜에 재구금/출석하는데 문제의 소지가 있을 경우;
-보석 중에 죄를 저지를 위험이 있는 경우;
-증인에게 영향력을 행사하거나 다른 방식으로 공무집행을 방해할 위험이 있을 경우.

보석승인을 거부할 수 있는 기타 이유로는 아래와 같다:
-피고 본인의 보호나 안전을 위해 필요하다고 판단되는 경우;
-피고가 복역 중인 죄수인 경우;
-피고에 대해 더 많은 정보가 필요한 경우;
-보고서를 작성하기 위한 목적으로 구금이 필요한 경우;
-경찰서에서 이루어진 마약검사에 대해 피고의 반응 결과가 양성이며, 해당 범죄가 마약에 의해 발생한 범죄인 경우;
-다른 범죄를 저질러 이미 보석으로 석방된 피고가 또다른 선택가능죄 혹은 가공소죄를 저질러 기소 당한 경우;
 
법원은 피고를 보석으로 석방할 때, 이후에 자진출두하는 데 문제가 되거나, 다른 범죄를 저지르거나 증인에게 영향을 주는 것을 막기 위해 다음과 같은 제한사항을 추가할 수 있다. 가장 일반적인 조건은:
-거주지 제한조건 (피고로 하여금 지정 주소지에 머물고 수면을 취하는 조건);
-통금 (전자발찌를 포함하거나 포함하지 않을 수 있음);
-경찰서 출석보고 (피고로 하여금 매일 혹은 정한 횟수에 따라 경찰서에 보고하도록 하는 것);
-여권 등 여행에 필요한 문서를 제출;
-검사측 증인 접촉금지;
-지정한 지역/장소 통행금지;
-보증금 (보증인이 피고가 지정날짜에 출두하지 않을 경우 피고를 대신하여 지정금액을 지불하겠다고 약속하는 것)
-보석금 (보증인이 피고를 대신하여 일정 금액을 실제로 법원에 지불하고 피고가 보석사항을 위반하여 자진출두 하지 않을 때, 돈을 잃게 되는 것)

보석 신청을 기각 혹은 받아들이거나 보석조건을 결정할 때, 법원은 다음 사항(및 기타 다른 해당사항)을 고려해야 한다:
-범죄의 성격 및 심각도(그리고 예상형량);
-피고에 대해 제시된 증거의 효력 정도;
-피고의 성품, 전적, 관련인 및 소속 커뮤니티 등;
-과거에 보석으로 석방되었던 기록;
-보석으로 풀려날 경우 피고가 초래할 가능성이 있는 신체적, 정신적 상해의 위험 정도.
 
피고는 두 차례에 걸쳐 법원에 보석 신청을 할 수 있다. 두 번의 신청이 모두 기각된 경우, 피고는 상황의 변화 등을 입증해야만 다시 보석 신청을 할 수 있다.


(b) 경찰 보석:
체포되어 경찰서로 연행된 경우, 담당경찰관은 먼저 체포된 피의자를 기소할 충분한 증거가 있는지를 고려해야 한다. 기소결정을 내리기 전, 담당경찰관은, 보석을 조건으로 혹은 보석조건 없이, 체포된 피의자를 석방하거나 심문이나 증거 보호/확보를 위해 경찰서에 구금할 수 있는 재량권을 가진다.

범죄를 저질러 체포된 자가 기소되면, 그는 보석을 전제로 혹은 전제하지 않고 일단 석방되어야 하는데 아래와 같은 경우는 피의자를 구금할 수 있다:
-체포된 피의자의 이름과 주소가 확인이 불가능한 경우 혹은 피의자가 제공한 이름이나 주소가 사실이 아니라고 의심할 만한 적절한 근거가 있는 경우;
-체포된 피의자가 법원에 출석하거나 지정날짜에 자진 출석하지 하지 못할 것으로 의심되는 적절한 근거가 있는 경우;
-체포된 피의자가 다른 범죄를 저지르는 것을 방지하기 위해 또는 다른 사람이나 재산에 실질적인 손상을 초래할 수 위험이 있어 이를 막기 위해 구금이 필요하다고 믿을만한 적절한 근거가 있을 경우;
-피의자에게서 샘플을 채취하기 위해 구금이 필요한 경우;
-피의자의 안전을 위해 구금이 필요한 경우; 혹은
-미성년자의 경우 본인의 이익을 위해 필요한 경우.

피고가 경찰 보석으로 석방될 경우, 지정한 날짜와 시간에 경찰서나 법원에 출두할 것을 알리는 통지서를 받게 된다. 보석에는 조건사항이 동반될 수 있고, 법정 보석과 비슷한 조건이 붙을 수 있다. 단, 경찰서에는 보석금(즉, 보증금 혹은 담보의 형태로)을 통한 석방절차가 없다.
-기소 후 경찰서에 구금된 경우, 가능한 빠른 시일 안에 치안판사법원으로 보내지게 되는데, 이는 첫 재판일 전이야 한다.


Bail

 (a)  Court bail:
 The general rule is that everyone has a right to be released on bail during criminal court proceedings unless one of the exceptions under schedule 1 of the Bail Act 1976 apply.
The most common exceptions are that there are substantial grounds for believing that, if released on bail, the defendant would:
  - Fail to surrender to custody on the next occasion; or
  - Commit an offence while on bail; or
  - Interfere with witnesses or otherwise obstruct the course of justice.
Other reasons for refusing bail include:
  - Where it is necessary for the defendant’s own protection or welfare;
  - Where he is a serving prisoner;
  - Where more information is required about the defendant;
  - Where it is necessary for the purpose of obtaining reports;
  - Where a defendant tested positive for drugs at the police station and the current offence was motivated by drugs.
  -Where the defendant has been charged with an either-way or indictable offence and he was already on bail for another matter when he committed the current offence.

When granting bail, the court may attach any conditions that it considers necessary to prevent the defendant from failing to surrender, committing further offences and interfering with witnesses. The most common bail conditions are:
  - A residence condition (requiring a defendant to live and sleep each night at a particular address);
  - A curfew (with or without electronic tagging);
  - A reporting condition (requiring a defendant to sign in at a police station daily or as many times a week as appear necessary);
  - To surrender his passport and any other travel documents;
  - Not to contact prosecution witnesses;
  - Not to enter a particular borough/street or place;
  - A surety (where a person on behalf of the defendant promises to pay the court a certain amount of money if the defendant fails to attend court on the next occasion);
  - A security (where a person on behalf of the defendant actually lodges a certain amount of money with the court and forfeits it if the defendant fails to attend court on the next occasion).

When deciding whether or not to grant bail and what conditions to attach to bail, the court must take into consideration the following factors (and any other relevant factors):
 - The nature and seriousness of the offence (and the probable sentence);
 - The strength of the evidence against the defendant;
 - The character, antecedents, associations and community ties of the defendant;
 - The defendant’s record for answering  bail in the past;
 - The risk of physical or mental injury likely to be caused by the defendant if released on bail.
A defendant may make two bail applications to the court. After two failed bail applications, he must show that there has been a change in circumstances before a court will hear another bail application.


(b)  Police bail:
Where a person is arrested and brought to a police station, the custody officer must first determine whether he has sufficient evidence to charge that person with an offence.
Prior to making his decision on charge, the custody sergeant has a discretion to release an arrested person with or without bail or to detain him at the police station for questioning or to preserve or secure evidence.

Once a person arrested for an offence has been charged, he must be released from police detention either on bail or without bail, unless:
  - His name and address cannot be ascertained or there are reasonable grounds for doubting whether a name or address given by him is real;
  - There are reasonable grounds for believing that the person will fail to appear at court in answer to bail;
  - There are reasonable grounds for believing that detention is necessary to prevent the person from committing an offence or from causing physical injury to any person to property (in the case  of an imprisonable offences only);
  - There are reasonable grounds for believing detention is necessary to prevent him from interfering with the administration of justice or with the investigation of the offence;
  - Detention is necessary for a sample to be taken from him;
  - Detention is necessary for his own protection; or
  - It is in his own interests with regard to a juvenile.

If a defendant is given police bail, he must be given a notice telling him to attend the police station or a court at a particular date and time. He may also have conditions attached to his bail, which are similar to those that can be imposed by a court except that the police cannot impose a condition of a surety or a security.
If a person is detained in police custody after charge, he must be taken to the local magistrates court as son as practicable and in any event not later than the first sitting after charge.
