THE PROSECUTION OF CRIMINAL OFFENCES
범죄행위에 대한 기소

THE CHARGING DECISION
기소결정

1. In England and Wales, the police and the Crown Prosecution Service (CPS) always apply the same two-stage test(called the ‘Full Code Test’) to every case when deciding whether to charge a suspect with a criminal offence. A prosecution can only be started or continued when the case has passed both stages of the test. The stages are explained below.
잉글랜드와 웨일즈에서는 경찰과 검찰청(CPS)이 범죄행위를 저지른 것으로 추정되는 피의자의 기소여부를 결정할 때 항상 2단계에 걸친 테스트(Full Code Test라 칭함)를 하게 되어있다. 해당사건이 2단계의 테스트를 반드시 통과해야 기소가 시작되거나 진행될 수 있다.(아래 설명 참조)

Stage 1 : The Evidential Stage
제1단계: 증거단계

2. The police or prosecutors must be satisfied that there is sufficient evidence to provide a realistic prospect of conviction against each suspect on each charge. They must consider what the defence case may be and how likely it is to affect the prospects of conviction.
경찰 또한 검찰은 피의자가 해당 혐의와 관련하여 유죄판결을 받을 현실적인 가능성이 있을 만큼 증거가 충분한지 판단할 수 있어야 한다. 변호인측이 어떤 방식의 변호를 제시할지도 추정해봐야하며 또한 유죄선고를 받을 가능성에 어느 정도의 영향을 미칠지도 고려해 봐야 한다.

3. A case which does not pass the evidential stage must not proceed, no matter how serious or sensitive it may be.
증거단계를 통과하지 못한 사건은 아무리 심각하고 민감한 사건이라 하더라도 기소로 이어질 수 없다.

4. When considering the evidential stage, police and prosecutors will consider the following questions:
증거단계에 있어 경찰과 검찰은 다음과 같은 요소들을 고려한다:

a. Can the evidence be used in court?Prosecutors will consider whether there is a question over the admissibility of certain evidence. In doing so, they consider the likelihood of evidence being held inadmissible by the court and the importance of that evidence in relation to the evidence as a whole.
증거가 법정에서 채택될 수 있는가? 검찰은 법정에서 증거의 채택여부에 대한 의문이 있을 수 있는지를 검토한다. 재판부가 증거를 채택하지 않을 가능성을 고려하며, 해당 증거가 전체 증거에서 차지하는 중요성 역시 고려한다.

b. Is the evidence reliable? Consideration will be given to whether there are any reasons to question the reliability of the evidence, including its accuracy or integrity.
증거는 확실한가? 정확도와 온전도 등 증거의 확실성에 의문을 제가할 만한 요소들이 있는지를 검토한다.

c. Is the evidence credible? Consideration is given to whether there are any reasons to doubt the credibility of the evidence.
증거는 믿을만 한가? 증거의 신빙성에 의심을 받을만한 요소들이 있는지를 검토한다.

Stage 2 : The Public Interest Stage
제2단계: 공공의 이익 단계

5. In every case where the police or the prosecutor believes that there is sufficient evidence to justify a prosecution, they must then go on to consider whether a prosecution is required in the public interest.
검찰과 경찰이 피의자를 기소하기 위한 충분한 증거가 확보되었다고 판단할 경우, 이러한 기소가공공의 이익을 위해 필요한 지의 여부를 판단하게 된다.

6. It has never been the rule that a prosecution will automatically take place once the evidential stage is met. A prosecution will usually take place unless the prosecutor is satisfied that there are public interest factors tending against prosecution which outweigh those in favour.
증거단계가 충족되었다고 해서 검찰이 반드시 기소해야 한다는 원칙은 존재하지 않는다. 하지만 검찰측이 기소가 공공의 이익에 적합하지 않다는 결론을 내리지 않는 이상 대체적으로 기소가 이루어진다.

7. In some cases the prosecutor may be satisfied that the public interest can be properly served by offering the suspect the opportunity to have the matter dealt with by an out-of-court disposal such as a caution, rather than bringing a prosecution.
경우에 따라서는 검찰이 기소보다는 훈방 등 법정을 통하지 않고 사건을 해결하는 것이 공공의 이익차원에서 더 적합하다고 판단할 수도 있다.

8. When deciding whether a prosecution is in the public interest, police and prosecutors have to consider each of the following questions below, although they are not exhaustive and not all of the questions may be relevant in every case. The weight to be attached to each of the questions will vary according to the facts and merits of each case. It is quite possible that one public factor alone may outweigh a number of other factors which tend in the opposite direction.
공공의 이익 차원에서 기소를 결정할 경우, 경찰과 검찰은 아래와 같은 요소들을 고려해야 하지만 반드시 모든 요소들을 다 고려해야 하는 것은 아니며 모든 요소들이 다 해당사건에 관련이 있지 않을 수도 있다. 각 요소의 중요성은 해당사건의 특징에 따라 차이가 날 수 있다. 기소를 가능하게 하는 한가지 요소가 기소의 필요가 없는 나머지 요소들을 다 합친 것보다 더 중요할 수도 있는 것이다.

9. The questions are:
요소들은 다음과 같다.

a. How serious is the offence committed? The more serious the offence, the more likely that a prosecution is required.
범죄행위의 심각성은 어느 정도인가? 범죄행위가 심각할수록 기소될 가능성이 높다.

b. What is the level of culpability of the suspect? The greater the suspect’s culpability, the more likely it is that a prosecution is required.
피의자의 과실 정도는 어느 정도인가? 피의자 과실정도가 클수록 기소될 가능성이 높다.

c. What are the circumstances of and the harm caused to the victim? The circumstances of the victim are highly relevant. The greater the vulnerability of the victim, the more likely it is that a prosecution is required. In deciding whether a prosecution is required in the public interest, prosecutions should take into account the views expressed by the victim about the impact that the offence has had on them. In some cases, this may also include the views of the victim’s family. However, the CPS does not act for victims or their families in the same way as solicitors act for their clients and prosecutors must form an overall view of the public interest.
피해자의 상황 및 피해 정도는 어떠한가? 피해자의 상황은 상당히 중요하다. 피해자의 취약성이 클수록 기소될 가능성이 높다. 공공이익의 차원에서 기소를 결정할 때에, 검찰은 피해자의 의견 그리고 사건이 피해자에게 미친 영향을 고려해야 한다. 경우에 따라서는 피해자의 가족의 의견도 수렴할 수 있다. 하지만 검찰은 변호사들이 의뢰인을 대표하듯이 피해자를 대표하는 것이 아니기에 공공이익의 차원에서 종합적인 결정을 내려야 한다.

d. Was the suspect under the age of 18 at the time of the offence? The best interests and welfare of a child or young defendant must be considered including whether a prosecution is likely to have an adverse impact on his or her future prospects that is disproportionate to the seriousness of the offending.
피의자가 범죄행위를 할 당시 18세 미만이었는가? 검찰의 기소가 사건의 심각성에 비해 한 미성년 피고인의 미래에 어떤 부정적인 영향을 미칠지의 여부 등도 고려되어야 한다.

e. What is the impact on the community? The greater the impact on the community the more likely it is that a prosecution is required.
지역사회에 미칠 영향은 무엇인가? 지역사회에 미치는 영향이 클수록 기소될 가능성이 높다.

f. Is prosecution a proportionate response? Prosecutors must consider whether prosecution is proportionate to the likely outcome, and in doing so consider the cost to the CPS and the wider criminal justice system, especially where it could be regarded as excessive when weighed against any likely penalty.
기소가 적합한 대응인가? 검찰은 기소의 결과로서의 처벌이 검찰을 포함한 사법기관이 부담해야할 비용 대비 과연 균형적이고 적합한가를 판단해야 한다.

g. Do sources of information require protecting? Special care should be taken when proceeding with a prosecution where details may need to be made public that could harm sources of information, international relations or national security.
정보제공자를 보호해야 하는가? 그 내용이 법정에서 공개될 때 정보제공자, 국제관계 또는 국가안보가 해를 입을 수 있는 가능성이 있을 경우, 기소과정에 특별한 주의가 필요하다.

10. If either or both of the stages of the Full Code Test are not met, no further action must be
taken against the suspect.
2단계 중 한 단계 또는 두 단계 모두 충족하지 못할 경우, 피의자에 대한 추가적인 제재는 이루어지지 않는다.

11. If both stages of the test are met, then the suspect will be charged with the relevant offence(s).
2단계 모두 충족된 경우, 피의자는 해당 범죄행위로 기소된다.


POST CHARGE REVIEW
기소후의 검토

12. Once charged, the CPS have a continuing to review a case to make sure that it continues to meet both stages of the Full Code Test.
기소후, 검찰은 사건이 계속 Full Code Test를 충족하는지의 여부를 검토해야 한다.

13. If circumstances change, for example, because the victim has produced a withdrawal statement saying that he/she no longer wishes to support the prosecution, then the prosecutor must consider whether:
예를 들어 피해자가 기소 중지를 공식적으로 요청하는 등 상황이 변동될 경우, 검찰은 다음과 같은 요소들을 고려해야 한다:

a. There is still sufficient evidence to support the prosecution; and
기소를 뒷받침할만한 증거가 충분한가?

b. It remains in the public interest to continue the prosecution.
기소를 계속하는 것이 공공이익의 차원에서 필요한가?

14. The same considerations mentioned above are relevant such as: how serious the offence is; the culpability of the offender; the victim’s views; and the likely outcome of the prosecution.
범죄행위의 심각성, 피의자의 과실정도, 피해자의 의견, 판결의 가능성 등도 고려대상이다.


AGREEMENTS BETWEEN THE VICTIM AND THEIR ATTACKER
피해자와 가해자간의 합의

15. In England and Wales, there is no rule and no guarantee that an agreement for compensation between the victim and the perpetrator will prevent a prosecution from starting or proceeding. The prosecutor will always apply the two-stage test but will take into consideration any views expressed by the victim.
잉글랜드와 웨일즈에서는 피해자와 가해자간에 금전적인 합의가 이루어졌다고 해서 기소 또는 기소의 진행이 중지된다는 규정도 없고 보장도 없다. 검찰은 항상 2단계 테스트를 적용하지만 피해자의 의견도 고려한다.

16. In most cases where the victim and the perpetrator are known to each other, the police and/or the prosecution will ask for or impose a bail condition (where the suspect is on bail) which prevents the defendant from contacting the victim, directly or indirectly. This prevents any contact with the victim directly by the defendant or through family members for the purpose of trying to agree a settlement.
피해자와 가해자가 서로 아는 사이인 경우, 경찰 그리고/또한 검찰은 피의자가 피해자를 직접 또는 간접적으로 연락하지 못하도록 하는 보석조건을 요청하거나 부과한다. 이런 경우 피고인이나 피고인의 가족들이 합의를 이루어내기 위해 피해자와 연락을 하는 것이 원천적으로 봉쇄된다.

17. If such a bail condition is in place, any contact with the victim made directly by the defendant or indirectly through the defendant’s or victim’s family will be looked at very negatively by the court and may lead to the prosecution asking the court to take bail away on the ground that the defendant is interfering with the witness. The defendant may also be charged with a further offence of Interfering with a witness, which is a serious offence and can attract a custodial sentence.
이러한 보석조건이 적용된 경우, 피고인이나 피고인의 가족들이 합의를 이루어내기 위해 피해자와 연락을 하는 것은 법정에서 상당히 부정적으로 비추어지며, 검찰측은 이를 피고인이 증인을 매수하려고 한다는 근거로 삼아 보석취소를 요청할 수 있다. 피고인은 증인매수죄라는 무거운 범죄로 추가 기소될수도 있으며, 이로 인해 징역형을 선고 받을 수 있다.

18. Where the defendant is in custody or he is not subject to any bail conditions, although strictly there is nothing preventing him/her from contacting the victim, if the victim reports it to the police, the defendant is still at risk of either having his/her bail taken away or being charged with the further offence of Interfering with a witness.
피고인이 구금 상태 또는 보석조건이 적용되지 않은 경우 그가 피해자를 연락하는 것을 방지할 요소는 없으나, 피해자가 이를 경찰에 신고할 경우 피고인은 보석이 취소되거나 증인매수죄로 추가 기소될 가능성이 있다.

19. Any attempt to contact prosecution witnesses therefore is always at the risk of the defendant.
검찰측 증인들을 연락하려는 행위는 피고인에게 전적으로 책임이 있다.

20. Negotiations are therefore mostly best conducted through the police and the prosecution. For example, in cases involving fraud or theft, the defence solicitors may ask the police to speak to the victim and ask whether they would be willing to withdraw their statement if they were repaid the money or otherwise compensated for their loss.
합의를 위한 협상은 경찰이나 검찰을 통해서 이루어지는 것이 가장 좋다. 예를 들어 사기행위나 절도행위의 경우 피고인의 변호인은 경찰에게 만약 피해자에게 금전적 혹은 다른 방식으로 피해를 보상해줄 경우 피해자가 기소요청을 중단할 의사가 있는지를 확인해줄 것을 요청할 수 있다.

21. If any negotiations with the victim are successful, they can make a ‘withdrawal statement’ to the police stating their wish for the prosecution not to be commenced or to be brought to an end. The police and the prosecution will then take the withdrawal statement into account when deciding whether to charge or continue the prosecution against a defendant.
피해자와의 협상이 이루어질 경우, 피해자는 경찰에게 기소를 하지말아 달라거나 기소를 중지해달라는 ‘기소철회서’를 제출할 수 있다. 그러면 경찰과 검찰은 피고인에 대한 기소를 할 것이냐 진행할 것이냐를 결정하는 데에 있어 이 기소철회서를 감안한다.

22. However, because there are a number of factors that the prosecution have to consider when applying the Full Code Test, a withdrawal statement from a victim is not a guarantee that a prosecution will be stopped. For example, in serious cases such as rape or those involving death or racially motivated offences, the prosecutor may continue the prosecution anyway by relying on other evidence (for example if the offence was witnessed by others, the trial can continue on the evidence of those other witnesses even if the victim is unwilling to attend the trial). Also, if the prosecution believe that the offences are likely to be repeated or it is otherwise in the victim’s best interest for the prosecution to continue (for example in cases of domestic violence), upon receiving a withdrawal statement the prosecution may apply to the court for a witness summons which requires the victim to attend court to give evidence. If they are served with a witness statement and do not attend, they risk being charged with an offence themselves.
하지만, Full Code Test를 시행하는 데에 있어 여러가지 요소를 감안해야 하므로, 피해자가 기소철회서를 제출했다고 해서 기소가 중지된다는 보장은 없다. 예를들어, 강간, 살해, 인종차별적인 동기로 발생한 범죄 등과 같은 무거운 중죄인 경우, 검찰은 피해자의 협조없이 다른 증거물(예를들어 범죄행위를 목격한 증인들의 증언)에 의존하여 기소를 계속할 수 있다. 또한, 검찰이 판단하기에 재범의 가능성이 있고 피해자의 안전을 위해 기소가 진행되어야 한다면(예를들어 가정폭력 등) 검찰은 피해자에게 증인소환장을 보내어 강제적으로 증언을 할 것을 재판부에 요청할 수 있다. 피해자가 증인소환장을 받았음에도 법정에 출두하지 않으면 기소당할 가능성이 있다.


VICTIM IMPACT STATEMENTS
범죄가 피해자에게 미친 영향에 대한 진술

23. If the prosecution does proceed and the defendant is convicted, the victim can ask the judge to take their victim impact statement into consideration which can ask the judge to be lenient when passing sentence, however, the length or type of sentence passed is ultimately up to the judge.
기소가 진행되고 피고인이 유죄선고를 받는 경우, 피해자는 판사에게 진술서를 제출하여 관대하게 처분해줄 것을 요청할 수는 있다. 하지만 형의 종류나 형량의 길이는 전적으로 판사의 결정이다
